Terms and Conditions

Please read these Terms carefully. They contain important limitations and explain your responsibilities when ordering perishable food.
1. Acceptance of These Terms
These Terms and Conditions ("Terms") are a legally binding agreement between you and Kilam Foods Inc. doing business as Healthy Tiffin ("Healthy Tiffin," "we," "us," or "our"). These Terms govern your access to and use of myhealthytiffin.com, any related webpages, ordering tools, customer accounts, text-message programs, and the meal, pantry, school-lunch, gift-card, referral, delivery, pickup, and related services we provide (collectively, the "Services").
By visiting the website, creating an account, placing an order, enrolling in a program, submitting content, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Additional terms shown at checkout or for a particular promotion, school, corporate account, recurring plan, gift card, or product are incorporated into these Terms. If those additional terms conflict with these Terms, the more specific terms control for that offering.
2. Eligibility and Customer Accounts
You must be at least 18 years old and able to enter into a binding contract to place an order or create an account. A parent or legal guardian must place school-lunch orders for a minor. You agree to provide accurate, current, and complete information and to keep your account, delivery address, access instructions, email address, and mobile number updated.
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Notify us promptly if you believe your account or payment method has been used without authorization. We may refuse, suspend, or terminate accounts that contain inaccurate information, are used fraudulently, violate these Terms, or create safety, operational, or legal concerns.
3. The Services and Menu Availability
Healthy Tiffin offers prepared meals and related products, which may include lunch items, dinner tiffins, a la carte meals, school lunches, pantry items, beverages, gift cards, corporate programs, referral programs, and other offerings displayed from time to time. Service areas, order minimums, order cutoffs, delivery days, delivery windows, prices, packaging, menus, portion descriptions, and available dietary categories may change without notice.
Menus rotate and ingredients are seasonal. Product photographs are illustrative. Actual color, texture, appearance, portion presentation, garnish, packaging, and ingredient sourcing may vary. We may limit quantities, discontinue an item, reject an order, or substitute a reasonably comparable ingredient or menu item when necessary because of availability, quality, food-safety, or operational considerations. We will make commercially reasonable efforts to keep material ingredient and allergen information current, but customers with allergies or strict dietary requirements must contact us before ordering and review the information provided with each delivery.
4. Orders, Pricing, Taxes, and Payment
An order is an offer to purchase. Your order is accepted only when we send an order confirmation or begin preparing it. We may contact you to clarify an order, correct an obvious error, or request additional information. We may cancel or limit an order and issue an appropriate refund when an item is unavailable, the address is outside our service area, payment cannot be authorized, fraud is suspected, or fulfillment would be unsafe or impracticable.
Prices, order minimums, delivery fees, container fees, taxes, and other charges are shown before checkout and may change for future orders. You authorize us and our payment processors to charge the payment method you provide for the full amount displayed at checkout, including applicable taxes and fees. You represent that you are authorized to use the payment method. We do not require tips unless a specific program expressly states otherwise.
Errors in pricing, descriptions, discounts, or availability may occur. We may correct an error before fulfillment. If a correction increases the price, we will seek your approval or cancel and refund the affected item or order. Promotional codes, credits, and discounts may be subject to separate terms, may not be combined, have no cash value, and may be withdrawn in cases of error, abuse, duplication, resale, or fraud.
5. Order Cutoffs, Changes, and Cancellations
Order cutoffs are displayed on the website or at checkout. Healthy Tiffin currently generally requires next-day orders to be placed by the stated cutoff and requires at least 24 hours' notice for cancellations. A different cutoff may apply to school lunches, corporate programs, catering, holidays, special menus, or other offerings.
To request a change or cancellation, contact us using the account tools or contact information provided for the applicable order. A request is effective only when received and confirmed by us. Because ingredients and production are planned around confirmed orders, orders canceled or changed after the applicable cutoff may be nonrefundable. We may, but are not required to, provide a credit or accommodation.
Customer-entered mistakes, including an incorrect date, address, school, student, meal selection, access code, phone number, or dietary note, do not automatically entitle the customer to a refund after the cutoff. Please review your order confirmation immediately and contact us promptly about any error.
6. One-Time Orders and Recurring Plans
Unless an offer is clearly identified at checkout as a subscription, automatic-renewal plan, or continuous-service plan, your Healthy Tiffin order is a one-time purchase and will not automatically renew.
If we offer a recurring plan, the specific recurring price, billing frequency, renewal terms, minimum commitment if any, cancellation method, and effective date of cancellation will be clearly disclosed before enrollment. We will obtain any affirmative consent required by law and provide a post-purchase acknowledgment. You may cancel through the method stated at enrollment and through any additional method required by law. Plan-specific terms control over this section. Cancellation stops future renewals but does not automatically refund an order already prepared, fulfilled, or past its applicable cancellation cutoff.
7. Delivery, Pickup, and Safe Drop-Off
Delivery is available only in designated areas. Delivery windows and tracking estimates are estimates, not guarantees. Traffic, weather, road closures, order volume, cooking timelines, building access, school schedules, and other circumstances may affect arrival times. We may use employees, contractors, or third-party logistics providers to complete deliveries.
You must provide a complete and accurate delivery address, unit number, gate or access code, school or office details, recipient name, and safe delivery instructions. You authorize us to rely on those instructions. Unless you require handoff and we agree in writing, you authorize unattended delivery at the designated location. Once the order is delivered according to your instructions, responsibility for theft, weather exposure, pests, tampering, spoilage, or loss generally passes to you.
If we cannot safely or legally access the location, cannot contact you, cannot locate the recipient, or cannot leave the order in a reasonable place, we may return or dispose of the order. Delivery fees and the food charge may remain payable because prepared food cannot ordinarily be resold. We may attempt redelivery for an additional fee when operationally possible.
For pickup orders, you are responsible for collecting the order within the stated window and for transporting and storing it safely. School and corporate deliveries may be made to an authorized representative, front desk, designated room, or other agreed drop point; delivery to that point constitutes delivery to the customer.
8. Reusable Steel Tiffins and Other Packaging
Reusable steel tiffins, lids, bags, ice packs, racks, or similar reusable items supplied through a return program remain Healthy Tiffin property unless expressly sold to you. Minimum order-day requirements, rental fees, deposits, replacement charges, or other program terms may be shown at checkout or in program communications.
Please empty, rinse, and return reusable items at the next scheduled delivery or pickup, following the instructions we provide. Do not place steel tiffins in a microwave. You are responsible for loss, misuse, unreasonable damage, or failure to return reusable items. We may charge the then-current replacement amount to the payment method on file after providing notice, suspend reusable-container service, or require disposable or plant-based packaging for future orders.
Pickup times for empty tiffins are estimates. If you authorize porch pickup, place the rinsed items in the agreed location and accept the ordinary risks associated with unattended pickup. We are not responsible for personal items accidentally left inside returned containers or bags.
9. Allergies, Dietary Preferences, and Ingredient Information
FOOD ALLERGIES CAN BE SERIOUS OR LIFE-THREATENING. Healthy Tiffin kitchens and suppliers handle major allergens and other ingredients, including milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy, sesame, seeds, legumes, spices, coconut, and mustard. Even when an item is described as vegan, vegetarian, Jain, Saatvik, gluten-free, nut-free, dairy-free, soy-free, or otherwise suitable for a dietary preference, cross-contact may occur during sourcing, storage, preparation, cooking, packaging, transport, or service.
We do not guarantee an allergen-free environment. Labels and website information are intended to help customers make choices but are not a substitute for contacting us. Recipes, supplier formulations, and ingredients may change. Before ordering, customers with an allergy, celiac disease, intolerance, pregnancy-related restriction, medication interaction, religious restriction, or other medically significant dietary requirement must contact us and determine whether the meal is appropriate. We may decline to accommodate a request that we cannot safely fulfill.
Order notes are not a guarantee that a modification can be made. A note is accepted only if we expressly confirm it. For school-lunch orders, the parent or guardian is responsible for communicating allergies and medical requirements to both Healthy Tiffin and the school and for ensuring that the school's emergency and meal-handling procedures are appropriate.
10. Nutrition, Wellness, and Ayurvedic Information
Calories, macros, micronutrients, portion sizes, ingredient benefits, dietary tags, and other nutrition information are estimates based on recipes, supplier information, food databases, standard portions, or other reasonable methods. Natural ingredient variation, cooking yield, substitutions, and serving differences may cause actual values to vary.
The website and Services may discuss clean eating, Ayurveda, digestion, detox, immunity, inflammation, blood sugar, weight management, heart health, gut health, or other wellness topics. This content is provided for general educational and informational purposes only. It is not medical advice and is not intended to diagnose, treat, cure, mitigate, or prevent any disease or health condition. No meal or program is guaranteed to produce a particular health result.
Consult a qualified health-care professional before making dietary changes if you have a medical condition, take medication, are pregnant or nursing, have a history of eating disorders, or are ordering for a child, older adult, or other person with special needs. In an emergency or suspected allergic reaction, stop consuming the food and seek immediate medical assistance.
11. Food Safety, Storage, and Reheating
Inspect your order promptly after delivery. Follow product labels and food-safety instructions. Refrigerate perishable food promptly and, in any event, within two hours after delivery or within one hour when the ambient temperature is above 90°F. Discard food that has been left unrefrigerated beyond safe limits, appears tampered with, has an unusual odor or appearance, or may otherwise be unsafe.
Consume food by the use-by date or time provided. Keep hot and cold foods at safe temperatures. Reheat food thoroughly using an appropriate appliance and container. Do not microwave steel containers or metal lids. Customers are responsible for safe storage, reheating, serving, and handling after delivery. Healthy Tiffin is not responsible for illness, spoilage, or quality loss caused by delayed retrieval, improper storage, unsafe reheating, customer handling, or consumption after the recommended time.
12. Quality Concerns, Refunds, and Credits
Because meals and most pantry products are perishable, they are generally final sale and cannot be returned. If an item is missing, incorrect, damaged, unsafe, materially different from the order, or delivered to the wrong location, contact us as soon as possible and no later than 24 hours after delivery. Include the order number, a description, and photographs when reasonably available. Keep the food and packaging if we ask to inspect them or provide information for a safety review.
After reviewing the circumstances, we may replace the item, redeliver, issue a partial or full refund, provide store credit, or take another reasonable action. The remedy will depend on the nature of the issue, evidence available, food-safety considerations, and applicable law. Taste preferences, expected spice levels, normal seasonal variation, minor presentation differences, customer ordering errors, and late cancellations ordinarily do not qualify for a refund.
Refund timing depends on the payment provider and financial institution. Credits are promotional, may expire if disclosed when issued, are not transferable, and are not redeemable for cash except where required by law.
13. Gift Cards, Promotions, and Referral Programs
Gift cards and account credits may be used only for eligible Healthy Tiffin purchases and are subject to any terms disclosed at issuance. Gift cards are not redeemable for cash except where required by law. Protect gift-card codes as you would cash; we are not responsible for unauthorized use unless caused by our breach of law or these Terms.
Promotions and referral programs may have eligibility limits, minimum purchases, geographic restrictions, expiration dates, single-use limits, and rules against self-referral, duplicate accounts, commercial distribution, or misuse. We may withhold or reverse a reward obtained through fraud, manipulation, returned orders, chargebacks, or violation of program terms. Where required, additional privacy or financial-incentive notices will be provided at enrollment.
14. School Lunch, Corporate, and Group Programs
A person placing a school-lunch order represents that the person is the student's parent, legal guardian, or otherwise authorized to order and provide the student's information. Provide only the information reasonably needed to identify the student and deliver the meal, such as the student's name, school, grade, classroom, teacher, dietary notes, and meal selection.
School menus, service dates, pickup locations, and deadlines may depend on school calendars and school instructions. Closures, minimum participation, schedule changes, or school restrictions may require cancellation or substitution. We may share limited order and delivery information with the school or program administrator as necessary to provide the service, address safety concerns, reconcile orders, or comply with the applicable agreement.
Corporate, institutional, event, and group orders may be governed by a separate proposal or agreement. If there is a conflict, the signed agreement controls for that program.
15. Email, SMS, and Mobile Messages
We may send transactional communications about accounts, orders, delivery tracking, tiffin pickup, service changes, food-safety matters, and customer support. These messages are part of the Services and may be sent even if you opt out of marketing, to the extent permitted by law.
We send marketing emails or text messages only as permitted by law and according to the consent collected. Consent to marketing is not a condition of purchase. Message frequency varies. Message and data rates may apply. To stop marketing texts, reply STOP or use another reasonable opt-out method stated in the message. For help, reply HELP or contact us. To unsubscribe from marketing email, use the unsubscribe link. An opt-out may take a reasonable period to process and does not prevent nonmarketing messages related to an existing transaction.
You represent that the mobile number you provide belongs to you or that you are authorized to consent for that number. Notify us before changing or relinquishing the number. Mobile carriers are not liable for delayed or undelivered messages. We may use service providers to send and manage communications, subject to our Privacy Policy.
16. Reviews, Feedback, Photos, and Other Content
If you submit a review, testimonial, recipe suggestion, photograph, video, social-media tag, survey response, or other content ("User Content"), you retain ownership of your content but grant Healthy Tiffin a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to host, reproduce, edit for length or formatting, display, publish, distribute, and use the content to operate, improve, and promote the Services, subject to applicable law and our Privacy Policy.
You represent that you have the rights and permissions necessary to submit the User Content and that it is accurate, lawful, and does not violate another person's privacy, publicity, intellectual-property, or other rights. Do not submit confidential information, personal information about another person without authorization, or content that is defamatory, threatening, discriminatory, obscene, fraudulent, or misleading. We may moderate or remove User Content but are not required to do so.
Ideas and general feedback may be used without restriction or compensation, unless we have agreed otherwise in writing.
17. Acceptable Use
You may not use the Services to violate law; infringe rights; impersonate another person; submit false information; obtain unauthorized discounts or credits; conduct fraudulent chargebacks; interfere with website security; introduce malicious code; scrape or harvest data without permission; reverse engineer the Services; resell meals without authorization; harass staff, drivers, schools, or other customers; or create a health or safety risk.
We may investigate suspected violations, preserve relevant information, cooperate with authorities, cancel orders, restrict payment methods, suspend accounts, or take other lawful action.
18. Intellectual Property
The website, software, menus, recipes as presented, photographs, videos, text, graphics, logos, trademarks, packaging designs, and other Healthy Tiffin content are owned by or licensed to Healthy Tiffin and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable license to use the website solely to evaluate and purchase the Services.
You may not copy, modify, distribute, sell, license, publicly display, create derivative works from, or commercially exploit our content without prior written permission. "Healthy Tiffin," related logos, and other marks may not be used in a way that suggests sponsorship or endorsement without authorization.
19. Third-Party Services and Links
The Services may rely on or link to third-party platforms for ecommerce hosting, payment processing, maps, delivery tracking, customer support, reviews, referrals, analytics, advertising, social media, or other functions. Third parties may have their own terms and privacy practices. Healthy Tiffin is not responsible for third-party websites, content, products, security, availability, or acts, except to the extent required by law.
20. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, WEBSITE, CONTENT, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." HEALTHY TIFFIN DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE; THAT A DELIVERY WILL ARRIVE AT AN EXACT TIME; OR THAT A MEAL WILL MEET EVERY PERSONAL TASTE, DIETARY GOAL, OR HEALTH EXPECTATION.
These disclaimers do not limit any express written warranty or any consumer right that cannot lawfully be waived.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEALTHY TIFFIN AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR A CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HEALTHY TIFFIN FOR THE ORDER OR SERVICE GIVING RISE TO THE CLAIM OR (B) $100. These limitations do not apply to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, gross negligence, or death or personal injury to the extent caused by a party's legally actionable conduct.
Some jurisdictions do not allow certain exclusions or limits, so some provisions may not apply to you. In that event, liability is limited to the greatest extent permitted by law.
22. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Healthy Tiffin and its owners, officers, employees, contractors, and agents from third-party claims, damages, losses, and reasonable costs arising out of your unlawful use of the Services, violation of these Terms, infringement of another person's rights, misuse of a delivery or reusable container, or User Content you submit. This obligation does not apply to the extent a claim results from Healthy Tiffin's own negligence, willful misconduct, or violation of law.
23. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, and applicable federal law. Before filing a formal claim, you and Healthy Tiffin agree to make a good-faith effort to resolve the dispute by sending a written description of the issue and requested resolution to the contact information below and allowing 30 days for a response.
Unless applicable law permits or requires another forum, any court proceeding arising from these Terms or the Services must be brought in the state or federal courts located in Alameda County, California, and each party consents to personal jurisdiction and venue there. Either party may pursue an eligible claim in small-claims court. Nothing in these Terms limits a nonwaivable right to report a matter to a government agency or seek public injunctive relief where such a right cannot be waived.
24. Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate access, cancel future orders, or close an account if we reasonably believe you violated these Terms, created a safety or fraud risk, failed to pay amounts due, abused staff or service providers, or if the Services are discontinued. Provisions that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, liability limits, indemnification, disputes, and privacy-related obligations—will survive.
25. Changes to the Services or Terms
We may update the Services and these Terms. The "Last Updated" date will show when these Terms were revised. Material changes will be communicated as required by law, which may include posting notice on the website or sending an email. Changes apply prospectively from the effective date. Your continued use after the effective date constitutes acceptance, except where law requires additional consent.
26. General Provisions
If a provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. A waiver must be in writing and applies only to the specific instance. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, financing, sale, merger, or transfer of the Services. Headings are for convenience only.
We are not liable for delay or failure caused by events beyond reasonable control, including severe weather, wildfire, utility or internet outages, public-health events, labor disruptions, road closures, supplier failures, governmental actions, or other force-majeure events. Electronic communications and records satisfy legal writing requirements to the extent permitted by law.
